This Terms of Service Agreement (“Agreement” or “Terms”) constitutes a legally binding contract between the administration, developers, and owners of Clarke Bot (“we,” “us,” “our,” or “Provider”) and any individual, entity, or Discord server administrator (“you,” "your," or “User”) who accesses, invites, configures, or interacts with Clarke Bot, its website located at clarkebot.org, and all associated services, application programming interfaces (APIs), and support channels (collectively, the “Service”).
PLEASE READ THIS AGREEMENT CAREFULLY. BY ADDING CLARKE BOT TO A DISCORD SERVER, EXECUTING ANY COMMANDS, OR OTHERWISE UTILIZING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM ACCESSING OR USING THE SERVICE AND MUST IMMEDIATELY REMOVE THE BOT FROM YOUR SERVER.
1. Acceptance of Terms and Eligibility
Your use of the Service is conditioned upon your strict adherence to this Agreement. You affirm that you are at least thirteen (13) years of age, or the minimum age of digital consent in your jurisdiction. The Service is not intended for individuals under the age of 13.
1.1 Authority to Bind
If you are adding the Bot to a Discord server on behalf of an organization, community, or company, you represent and warrant that you possess the administrative authority to bind that entity to these Terms.
1.2 Platform Compliance
You acknowledge that your use of the Service must concurrently comply with the Discord Terms of Service, Discord Community Guidelines, and Discord Developer Terms of Service. Any violation of Discord’s official policies shall constitute a material breach of this Agreement.
2. Scope of Service and License Grant
Subject to your continuous compliance with this Agreement, the Provider grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use Clarke Bot for automated moderation and entertainment purposes within the Discord client software application. All right, title, and interest in and to the Service, including but not limited to custom code, command structures, branding, logos, website graphics, algorithms, and technical architecture, remain the exclusive property of the Provider. Nothing in these Terms shall be construed as transferring any intellectual property rights, copyrights, patents, or trade secrets to the User. All rights not expressly granted to you under this Agreement are strictly reserved by the Provider.
3. User Accounts and Server Setup
To utilize the administrative and auto-moderation components of the Service, you must hold the necessary Discord permissions (e.g., "Manage Server" or "Administrator") within the target server. You are entirely responsible for maintaining the security and confidentiality of your Discord account, API keys, and server configurations.
3.1 Security Incidents
You agree to immediately notify the Provider via official support channels of any unauthorized access, breach of security, or exploit related to your server’s interaction with the Service.
3.2 Configuration Liability
The Provider is not responsible for any operational failures, data deletion, or security gaps caused by incorrect configuration, misallocated Discord permission roles, or faulty setups performed by server administrators.
4. Permitted and Prohibited Conduct
You agree to use the Service exclusively for lawful purposes and in strict accordance with all local, state, national, and international laws and regulations. You shall not engage in, facilitate, or orchestrate any form of Denial of Service (DoS) attack, Distributed Denial of Service (DDoS) attack, or intentional request flooding aimed at clarkebot.org or the infrastructure hosting the Bot.
4.1 Vulnerability Discovery
If you discover a bug, glitch, vulnerability, or operational exploit within the Service, you must immediately report it to the Provider. Exploiting any such vulnerability for personal gain or server disruption is strictly prohibited.
4.2 Data Protection Restrictions
You are expressly prohibited from using automated scripts, self-bots, web scrapers, or other extraction utilities to harvest data, text, or code from the Service without explicit prior written authorization from the Provider.
5. Automated Moderation and Liability Disclaimers
Clarke Bot utilizes algorithmic data processing and text filtering to execute automated moderation tasks, including but not limited to kicks, bans, mutes, warning systems, and message deletions. You acknowledge that automated filtration systems are inherently imperfect and may result in "false positives" or "false negatives."
5.1 Indemnification against False Penalties
The Provider explicitly disclaims any liability for wrongful moderative actions, loss of server membership, damage to community reputation, or user grievances arising from automated filters or custom rule definitions configured by server staff.
5.2 Finality of Actions
The resolution of disputes between your server's users and your server's administration regarding actions executed by the Bot remains entirely your responsibility.
6. Service Availability and Performance Metrics
While the Provider targets a continuous ninety-nine point nine percent (99.9%) uptime metric for the Bot, this target is an objective and does not constitute a legal guarantee or service-level agreement (SLA). The Provider reserves the right to take the Service offline, restrict commands, or limit API responsiveness for scheduled maintenance, critical software patching, or unexpected hardware mitigation.
6.1 Technical Fluctuations
Network latency, Discord API rate limits, upstream hosting provider failures, and global internet routing issues may cause temporary degradation of Service performance for which the Provider bears no responsibility.
6.2 No Compensation For Downtime
Users are not entitled to monetary compensation, damages, or restitution of any kind due to temporary or prolonged service outages.
7. Modifications to the Service and Terms
The Provider reserves the right, at its sole discretion, to modify, update, enhance, deprecate, or permanently remove any specific feature, command, functionality, or database architecture within the Service at any time without prior liability or obligation to notify Users.
7.1 Unilateral Modifications to Terms
The Provider may amend, revise, or completely replace this Agreement at any time. The most current version of these Terms will always be maintained on clarkebot.org.
7.2 Notice and Deemed Acceptance
We will endeavor to notify users of material changes via announcement channels in our official support server or clear updates on clarkebot.org. Your continued access to or usage of Clarke Bot following the posting of any revisions or amendments constitutes your absolute and irrevocable acceptance of the modified Terms of Service.
8. Term and Termination
This Agreement commences on the date you first access or invite the Bot to a Discord server and will remain in full force and effect until terminated by either party. You may terminate this Agreement at any time by kicking, banning, or completely removing Clarke Bot from all Discord servers under your control and ceasing all interaction with clarkebot.org.
8.1 Right of Revocation
The Provider reserves the absolute, unreviewable right to terminate your access to the Service, blacklist specific Discord accounts, or restrict entire Discord guilds from using the Bot at any time, with or without cause, and without prior notice.
8.2 Survival of Provisions
Sections 5, 8, 11, 12, 13, 22, 23, and 24, along with any other provisions which by their nature ought to survive termination, shall survive the expiration or termination of this Agreement.
9. Privacy, Data Collection, and Storage
By utilizing the Service, you acknowledge and agree that Clarke Bot collects, processes, and stores certain data strings required for server functionality, including but not limited to Discord User IDs, Server IDs, channel logs, configuration metrics, and moderation histories. The handling, retention, and deletion of all data collected by the Service are strictly governed by the Clarke Bot Privacy Policy, accessible at clarkebot.org/privacy, which is hereby incorporated by reference into these Terms.
9.1 Data Subject Requests
If a user in your server requests data erasure in accordance with privacy regulations (such as GDPR or CCPA), you agree to utilize the appropriate built-in commands or contact our support desk to facilitate compliance.
9.2 Third-Party Subprocessors
You acknowledge that data collected by the Bot may be routed through and processed by third-party hosting providers and infrastructure partners essential to running the Service.
10. System Exploitation and Reverse Engineering
You shall not decompile, reverse engineer, disassemble, decrypt, or otherwise attempt to derive or extract the underlying source code, proprietary algorithms, or data models of Clarke Bot or clarkebot.org.
10.1 Security Testing Restrictions
Penetration testing, vulnerability scanning, and security auditing of the Service’s endpoints are strictly prohibited unless express, written, and signed authorization is obtained from the primary developer of Clarke Bot.
10.2 API Misuse and Clones
You shall not attempt to interface with the internal APIs of Clarke Bot via unapproved third-party software, scripts, or manual request forgery. Any unauthorized reproduction, cloning, or spoofing of the Bot's operational infrastructure will result in an immediate permanent ban from the Service and potential legal remedies.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
11.1 Specific Disclaimers
THE PROVIDER MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS, THAT THE SERVICE WILL BE COMPLETELY SECURE, ERROR-FREE, OR VIRUS-FREE, OR THAT THE RESULTS REAPED FROM MODERATION COMMANDS WILL BE PERFECTLY ACCURATE OR RELIABLE.
11.2 Risk Allocation
THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, AND OUTCOME OF YOUR USE OF THE SERVICE RESTS ENTIRELY WITH YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CREATORS, DEVELOPERS, OWNER(S), OR OPERATORS OF CLARKE BOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12.1 Covered Losses
THIS EXCLUSION INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, SERVER CORRUPTION, DATA BREACHES, LOSS OF GOODWILL, WORK STOPPAGE, OR COMPUTER MALFUNCTION, EVEN IF THE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.2 Maximum Liability Cap
IN NO EVENT SHALL THE PROVIDER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT, UNDER ANY LEGAL THEORY (INCLUDING CONTRACT, TORT, OR STRICT LIABILITY), EXCEED THE SUM OF TEN DOLLARS ($10.00 USD) OR THE TOTAL AMOUNT YOU PAID TO THE PROVIDER IN THE THREE (3) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESSER.
12.3 Basis of Bargain
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN THE PROVIDER AND YOU, WITHOUT WHICH THE SERVICE WOULD NOT BE FREELY PROVIDED.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Provider, its developers, contributors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs).
13.1 Scope of Indemnity
This indemnification obligation applies to any claims arising out of or in connection with your breach or alleged breach of any provision within this Agreement, your misuse or negligent deployment of the Bot, any content or behaviors occurring within a Discord server you administer, or your violation of any third-party right, including intellectual property or privacy rights.
14. Entertainment and Gaming Features
The Service contains built-in entertainment options, commands, virtual currency elements, games, and meme utilities.
14.1 Virtual Assets Disclaimer
All economy points, virtual coins, ranks, experience points (XP), or digital items accumulated within Clarke Bot's system are purely fictional, hold absolutely no real-world monetary value, and cannot be traded, sold, or redeemed for fiat currency.
14.2 Economy Resets and Fairness
The Provider reserves the right to wipe, clear, recalibrate, or reset virtual economies, server leaderboards, or profile stats at any time due to database re-indexing, server upgrades, or anti-cheat corrections. Using macros, script automation, multiple accounts, or system glitches to artificially inflate metrics is prohibited.
15. User-Generated Content and Message Filtering
By utilizing message filtration features, you acknowledge that your server’s text channels are actively scanned by the Bot in real-time. You assume sole responsibility for all text, images, attachments, or media uploaded to your Discord server by your community members.
15.1 Storage Limitations
Unless explicitly outlined in custom feature setups, Clarke Bot does not retain logs of clean messages indefinitely; logs are utilized dynamically to screen for prohibited text strings and then cleared from system memory.
15.2 Content Compliance
If any content transmitted through your server causes the Bot to violate external infrastructure rules (e.g., hosting platform terms), the Provider reserves the right to flag your server and restrict usage.
16. Monetization, Premium Features, and Donations
The primary operational core of Clarke Bot is offered to Discord servers entirely free of charge. The Provider may, at its option, introduce voluntary donations, premium tiers, or paid cosmetic features via platforms such as Patreon, Ko-fi, or direct processing links.
16.1 Non-Refundable Policy
All financial contributions, donations, and premium tier subscriptions are completely voluntary and strictly non-refundable under any circumstances, including service disruption or account termination.
16.2 Adjustments to Pricing
The Provider reserves the right to adjust premium tier thresholds, subscription models, or available paid features at its absolute discretion.
17. Brand Guidelines and Trademarks
The name "Clarke Bot," the domain name "clarkebot.org," the custom assets, graphics, and avatars designed for the Bot are proprietary trademarks and trade dress owned exclusively by the Provider. You may not use our branding, name, or logos in any manner that falsely implies endorsement, corporate affiliation, partnership, or sponsorship by the Provider.
17.1 Contextual Presentation
Any public reviews, videos, or articles featuring Clarke Bot must depict the Service accurately and without defamatory text alterations or malicious misrepresentation.
17.2 Derivative Works
Creating copycat bots, phishing platforms, or cloned websites utilizing the trademarked name or distinct structural layout of Clarke Bot is strictly forbidden.
18. Support Channels and Communication
Customer service, technical guidance, and operational assistance are conducted exclusively through the official website at clarkebot.org and the designated Discord Support Server. The Provider is under no obligation to provide support, updates, or error fixes via unsolicited private messages (DMs), email, external social media handles, or third-party web forums.
18.1 Conduct in Support Spaces
When interacting with Clarke Bot staff, developers, or community moderators, you agree to behave respectfully. Harassment, verbal abuse, threats, and toxic conduct in support spaces will result in immediate termination of support privileges and a global blacklist.
18.2 No Legal Notice via Support
Support tickets, Discord messages, or mentions do not constitute formal legal service or statutory notices under any circumstances.
19. Third-Party Links, Dependencies, and Services
The Service may contain hyperlinks, embedded contents, or backend dependencies linked to third-party web domains, APIs, or data providers.
19.1 External Services Disclaimer
The Provider exercises no operational control over, and assumes absolutely no liability for, the content, privacy structures, functionality, uptime, or business practices of any third-party websites or services.
19.2 Infrastructure Updates
You explicitly acknowledge that any reliance on external infrastructure or data sets is done at your own sole risk and discretion. If external dependencies or platform partners modify their systems, causing Clarke Bot features to break, the Provider is not responsible for the resulting loss of functionality.
20. Severability of Terms
If any individual section, clause, subsection, or phrase of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, unconstitutional, or completely unenforceable, such determination shall not affect the remaining components of the Terms. The invalid provision will be struck from the contract, and the remainder of the Agreement will continue to be interpreted and enforced to the maximum extent permissible under applicable law, giving full effect to the original economic and operational intent of the parties.
21. No Waiver of Rights
The failure, delay, or omission of the Provider to exercise or enforce any specific right, power, option, or legal remedy outlined in this Agreement shall not operate as a waiver of that right or any subsequent right. No waiver of any breach or provision within these Terms shall be deemed valid unless it is executed explicitly in writing and signed by an authorized representative of Clarke Bot.
22. Force Majeure
The Provider shall not be held liable or responsible for any failure, latency, degradation, or disruption of the Service resulting from causes beyond its reasonable operational control. This includes, but is not limited to: acts of God, natural disasters, fires, floods, global health crises, fiber-optic cable cuts, broad internet service provider disruptions, cloud hosting blackouts, labor disputes, civil unrest, war, governmental regulations, cyber warfare, or sudden programmatic blocks instituted by Discord Inc.
23. Governing Law and Jurisdictional Venue
This Agreement, and any legal disputes, claims, or controversies arising out of or relating to your use of Clarke Bot or clarkebot.org, shall be governed by, construed, and enforced in accordance with the internal substantive laws of the country and state in which the primary developer/owner resides, completely without giving effect to conflicts of law principles. You agree that any legal action, lawsuit, or judicial proceeding permitted under this Agreement shall be brought exclusively in the courts located within the primary operational jurisdiction of the Provider. You hereby consent and submit to the personal and exclusive jurisdiction of such courts.
24. Dispute Resolution and Class Action Waiver
Prior to filing any formal legal claim, arbitration request, or lawsuit, you agree to contact the Provider via the official website to attempt an informal, good-faith resolution of the underlying dispute within a sixty (60) day period.
24.1 Individual capacity only
YOU AND THE PROVIDER AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE ACTION.
24.2 Consolidation Restriction
Unless both you and the Provider agree otherwise in writing, a judge or arbitrator may not consolidate more than one individual person's claims or preside over any form of a representative class proceeding.
25. Entire Agreement and Comprehensive Merger
This Terms of Service Agreement, alongside the integrated Clarke Bot Privacy Policy, constitutes the entire, complete, and final legal agreement between you and the Provider regarding your utilization of the Service. This contract supersedes and replaces all prior or contemporaneous negotiations, discussions, promises, agreements, drafts, or understandings (whether written, verbal, or electronic) between you and the Provider regarding Clarke Bot. By running any Clarke Bot code or navigating clarkebot.org, you signify that you have relied on no external statements or guarantees outside what is explicitly documented within this 25-section Agreement.
